Terms of Use

By accessing or using BINify (the "Software") operated by BINify Technologies, LLC ("BINify," "we," or "us"), you agree to these Terms of Use. If you do not agree, do not access or use the Software.

These terms apply to all users of the Software, including business operators and their staff, customers of those operators, and visitors to BINify-hosted pages.

BINify is subscription software that helps independent operators run reusable moving-bin rental businesses. BINify provides tools for a branded website, bookings, inventory, rentals, delivery and pickup scheduling, pricing, customer management, communication, reporting, and team administration.

BINify does not supply bins, dollies, vehicles, or cleaning equipment; perform deliveries; sell territories; guarantee income; or operate any rental business on your behalf.

You are responsible for maintaining the security of your account credentials and for all activity under your account.

You represent that the business information, branding, inventory, pricing, policies, and content you publish through BINify is accurate and yours to use.

Each operator business controls its own brand, website, domain, customers, inventory, packages, pricing, payments, staff, delivery areas, and policies.

Operators are solely responsible for the bins, dollies, cleaning, delivery staff, vehicles, service quality, customer agreements, refunds, and compliance with all applicable laws, taxes, and regulations in their operating areas.

Operators provide their own reusable bins and delivery capabilities and are responsible for the condition, cleanliness, and availability of that inventory.

BINify does not take a percentage of operator rental revenue. Normal payment-provider processing fees may apply and are set by the operator's chosen payment provider.

You will not use BINify to engage in unlawful, deceptive, infringing, harmful, or fraudulent activity, or to misrepresent your services, availability, or pricing.

You will not attempt to access data that does not belong to your business, interfere with the Software, reverse engineer it, or use it to build a competing product.

Each business's data is kept separate. You will not attempt to access another operator's business, customers, inventory, or reports.

BINify charges a software subscription. Operators separately collect their own rental payments from their customers through their own payment connection.

Founding Membership is a limited offer for the first 100 paying businesses, at a locked monthly rate of $29.99, including all current and future features. The locked rate does not increase with future standard-plan pricing changes, and Founding Members are not shown upgrade prompts or paywalls for features.

Founding Membership status, the unique membership number, the locked price, and all-feature entitlement are recorded and enforced on BINify's servers. Membership is limited to one per business.

Standard plan pricing and feature allocations are provisional and will be finalized before the Founding Member offer closes. Once the first 100 memberships are claimed, the Founding offer closes and new businesses choose from the standard plans.

Transactions between an operator and its customers are solely between those parties. BINify is not a party to any rental agreement and is not responsible for bins, deliveries, refunds, disputes, or service quality.

Operators are responsible for their own rental agreements, terms, cancellation and refund policies, and any disclosures required in their service areas.

Operators may connect their own domain and customize their branded storefront. Operators are responsible for the content they publish and for any third-party content or links they include.

BINify may remove or restrict content or storefronts that violate these terms, applicable law, or the rights of others.

BINify and its logos, designs, and software are the property of BINify Technologies, LLC. Operator branding remains the property of the operator or its licensors.

You receive a limited, revocable, non-exclusive license to use the Software for the term of your subscription, subject to these terms.

Your use of BINify is also governed by our Privacy practices. We handle account and business information as described there and do not sell your data.

The Software is provided "as is" and "as available." BINify does not warrant that the Software will be uninterrupted, error-free, or fit for a particular purpose, and disclaims all warranties to the extent permitted by law.

BINify does not guarantee rental revenue, customer demand, business success, or any specific outcome from using the Software.

To the extent permitted by law, BINify's liability for any claim arising from these terms or the Software is limited to the amounts you paid BINify for the Software in the twelve months preceding the claim, and in no event will BINify be liable for indirect, incidental, special, consequential, or lost-profit damages.

We may update these terms as the Software evolves. We will provide notice of material changes. Continued use after the effective date means you accept the updated terms.

Changes to standard plan pricing will never increase a Founding Member's locked monthly rate.

You may stop using BINify at any time. We may suspend or terminate access for violations of these terms, unpaid subscriptions, or to protect the Software or other users.

Founding Membership pricing is a locked rate; it is not a one-time lifetime purchase and does not require forfeiture of the rate upon cancellation, reactivation, or a failed payment that is resolved.
